THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. Threecardone DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

ThreecardonSHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL Threecardone’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold Threecardone and its affiliates, officers, directors, employees, agents, and licensors harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these TOS.

Termination

Threecardone reserves the right to terminate your access to the Service at any time, with or without cause, without notice to you. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These TOS shall be governed by and construed in accordance with the laws of Pakistan, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts located in Pakistan for any dispute arising under these TOS.

Entire Agreement

These TOS constitute the entire agreement between you and Threecardone and govern your use of the Service, superseding any prior agreements between you and Threecardone. If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Threecardone’s failure to enforce any right or provision of these TOS shall not be deemed a waiver of such right or provision.

Changes to Terms of Service

Threecardone reserves the right to modify these TOS at any time without notice to you. By continuing to use the Service after any modifications to the TOS, you agree to be bound by such modifications. It is your responsibility to review these TOS periodically for changes.
